Same-Sex Marriages and Rights For The Gay/Lesbian Community

The year 2015 came with many changes in Florida’s legal system. One of the most significant changes that occurred in 2015 is that Florida has now legalized same-sex marriages. This paramount change in the Laws of Florida has given many rights to many people that they did not have before. With these new rights individuals may find themselves in the unfortunate position of needing a divorce. The gay and lesbian communities now have all the same rights and benefits given to heterosexual couples when it comes to divorce, such as equitable distribution, alimony, and even filing bankruptcy with their spouses. The same types of cases that use to only apply to heterosexual couples now apply to same–sex couples. There are two types of divorces: an Uncontested and Contested divorce which can include property distribution of assets and liabilities, spousal support as well as child custody disputes and child support.

Many heterosexual couples going through a divorce often find themselves in a position needing to file bankruptcy. Most individuals going through divorce these days have more debts than assets and often find themselves fighting over who get what debt instead of who gets what assets. Filing bankruptcy helps many parties clean up their divorce to make the divorce process go smoother and address the parties liabilities without the need to litigate over who gets more of the martial debt. Previously, only married couples were allowed to file bankruptcy together, which meant that the gay and lesbian community was not afforded that same right. That has now changed as well. Same-sex married couples can now file bankruptcy jointly which will help many same-sex couples save homes, cars, clean up their finances and help get that fresh start that many need.

The recent changes in Florida’s laws regarding same sex marriage have also had a direct impact on the issue of gay or same sex adoptions. At one point in time, gay adoptions were not allowed in Florida, but now that Florida recognizes and allows same sex marriages Florida also now allows gay adoptions. In addition, beginning in 2015 the Department of Children and Families will now approve joint adoptions by same-sex couples.
