Postnuptial Agreements in Orlando: When Are They Useful?

PostNup

Marriage does not freeze a couple’s financial life in place. Careers change, businesses grow, inheritances arrive, and priorities shift. For many Orlando couples, a postnuptial agreement offers a way to address these changes head-on rather than leaving financial expectations unspoken. But when does it actually make sense to consider one?

What Exactly Is a Postnuptial Agreement?

A postnuptial agreement, often called a “postnup,” is a written contract signed by spouses after they are already married. It typically outlines how property, debts, and financial rights will be handled in the event of divorce or death. Unlike a prenuptial agreement, which is signed before the wedding, a postnup is created once the marriage is already underway, often because circumstances have changed since the vows were exchanged.

Have you and your spouse started a business together? Received a significant inheritance? Noticed that one of you has taken on more financial risk than the other? These are the kinds of moments that often prompt couples to think seriously about putting something in writing.

Common Situations Where a Postnup Makes Sense

Every marriage is different, but certain scenarios tend to come up again and again when Orlando couples consider a postnuptial agreement. These include:

  • One spouse starting or acquiring a business after the wedding
  • A significant inheritance or gift received by one spouse
  • A couple deciding one spouse will leave the workforce to raise children
  • Concerns about a spouse’s debt or spending habits affecting shared finances
  • A desire to clarify how future income or property will be classified
  • Rebuilding trust and transparency after a rocky period in the marriage

If any of these sound familiar, it may be worth asking whether a postnup could bring clarity and reduce uncertainty for both spouses.

Why Transparency Matters So Much

Florida courts scrutinize postnuptial agreements more closely than prenuptial agreements. Because spouses are already bound by marital obligations when they sign, full and fair financial disclosure between spouses carries real weight when it comes to enforceability. Florida Statute 732.702 addresses the waiver of spousal rights and requires fair disclosure of each spouse’s estate when an agreement is executed after marriage. In other words, a postnup built on incomplete information or pressure is far more vulnerable to challenge down the road than one built on openness.

That is not meant to discourage couples from pursuing one. It simply means that the process matters as much as the paperwork. A postnup crafted thoughtfully, with each spouse fully informed, tends to hold up far better than one drafted hastily or without proper disclosure.
