Florida state law defines driving with a suspended license as someone who operates a vehicle on a Florida highway while knowing their license has been suspended or revoked. the individual would have knowledge of the license suspension either through a court order or by receiving a citation of the provision in place.

Driving with a suspended license in Florida is a criminal offense. it can either be a misdemeanor or a felony depending on the cause for suspension and any repeat violations involved. the prosecutor must prove that an individual has been aware of the license suspension. This is done by providing documentation such as government agency-issued citations about the suspension.

Punishments for driving with a suspended license depend on the number of offenses involved. First and second-time offenses are misdemeanors that can result in imprisonment up to 60 days and/or fines up to $500. a third-time offense is a felony. the penalty for that is a prison term up to five years and/or fines up to $5,000.
